Terms and Conditions
GENERAL TERMS AND CONDITIONS OF USE – TRUSTY
These General Terms and Conditions govern the access, browsing and use of the website apptrusty.eu and the associated mobile application (hereinafter, the “Platform”), owned by JORDI BERMÚDEZ DUQUE (hereinafter, “Trusty”).
Accessing and using the Platform implies full, express and unconditional acceptance of these Terms and Conditions, as well as the Privacy Policy and any other applicable legal texts.
1. Legal Nature of the Platform
Trusty is a digital technology intermediation platform that facilitates contact between:
- Users requesting home services (“Clients”)
- Independent professionals offering such services (“Professionals”)
Trusty does not directly provide the services offered on the Platform and does not act as employer, representative, agent, partner or subcontractor of the Professionals.
The contractual relationship for the provision of services is established exclusively between Client and Professional, with Trusty remaining entirely outside such contractual relationship.
2. Independence of Professionals
Professionals act as self-employed individuals or independent entities.
No employment, commercial partnership, agency, representation or dependency relationship exists between Trusty and the Professionals.
In particular:
- The Professional freely sets their own prices.
- Determines their availability.
- May accept or reject service requests.
- May provide services outside the Platform.
- Organizes their activity independently.
Trusty does not exercise direction, control or supervision over the material execution of the service.
3. Operation of the Service
The Client freely selects an available Professional within their area and submits a booking request.
Once the request is accepted, a direct contractual relationship is established between Client and Professional.
Trusty does not intervene in the execution of the service and assumes no responsibility for its outcome.
4. Payment System and Economic Flow
Payments are processed through an external provider (Stripe Connect) under a marketplace model.
Trusty acts exclusively as a temporary collection agent.
Funds paid by the Client do not constitute Trusty’s own revenue but are amounts in transit intended for the Professional.
Trusty may integrate into the final price a margin for technological intermediation services, platform maintenance and support.
The Professional is responsible for issuing the corresponding invoice to the Client for the service provided.
5. Tax Obligations
The Professional is solely responsible for:
- Declaring income obtained.
- Applying and remitting the applicable VAT.
- Complying with all tax and social security obligations.
Trusty assumes no fiscal responsibility regarding the Professional’s economic activity.
6. Claims and Mediation
The Client has 24 hours from the completion of the service to submit a claim.
Trusty may act as a neutral mediator to decide on the release of retained funds.
Trusty does not act as an arbitrator or judicial authority.
7. Limitation of Liability
Trusty shall not be liable for:
- Personal injury or property damage arising from the service.
- Contractual breaches between Users.
- Loss of profits or indirect damages.
- External technical failures.
- Unlawful acts of third parties.
In any case, Trusty’s maximum liability shall be limited to the amount effectively received as platform intermediation margin in the specific transaction concerned.
8. Exclusion of Joint Liability
Trusty shall not assume joint or subsidiary liability with respect to labor, tax or contractual obligations of the Professionals.
In the event of administrative or judicial claims against Trusty arising from a Professional’s actions, the Professional shall fully assume the legal defense and all associated costs.
9. Fraud Prevention
Trusty may suspend accounts and retain funds where reasonable indications of:
- Fraudulent claims.
- Abusive use of the system.
- Attempts to bypass payments outside the Platform.
10. Indemnification
The User agrees to indemnify and hold Trusty harmless from any claim, judicial proceeding, administrative sanction or expense arising from misuse of the Platform or breach of these Terms.
11. Force Majeure
Trusty shall not be liable for failures resulting from force majeure events, including network failures, administrative decisions or interruptions of the payment provider.
12. Intellectual Property
All Platform content is owned by Trusty or its licensors.
Reproduction or exploitation without express authorization is prohibited.
13. Data Protection
The processing of personal data is governed by Regulation (EU) 2016/679 (GDPR) and applicable Spanish legislation.
14. Modifications
Trusty may modify these Terms at any time, with effect from their publication.
15. Applicable Law and Jurisdiction
These Terms shall be governed by Spanish law.
For any dispute, the parties expressly submit to the Courts and Tribunals of Palma de Mallorca, waiving any other jurisdiction that may apply.
